Terms of Service

1. Who we are and agreement

MailQuell ("we", "us") is operated by MailQuell, Agadir, Morocco. Contact: support@mailquell.com.

By creating an account, using the web app, or calling our API, you agree to these Terms, our Privacy Policy and our Refund Policy. If you use MailQuell on behalf of a company, you confirm you may bind it to these Terms.

2. The service

MailQuell checks email addresses: syntax, domain and MX records, SPF/DMARC, disposable and role-based addresses, spam-trap risk signs (domain age from public registry data, parked domains, DNS blocklists — only the domain name is looked up), and — by opening a connection to the recipient's mail server and asking whether the mailbox exists — mailbox status. No email is sent to the addresses you check.

Results are an estimate. Mail servers can be configured to accept every address (catch-all), delay answers (greylisting) or block verification; mailboxes change over time. We don't guarantee that a result is correct or that emails you send later will be delivered.

AI Lead Qualification reads the public website of each company in your list and uses an AI model to estimate whether it matches the profile you describe. Its answers are automated estimates based only on what the website says, and can be wrong; review them before you rely on them, and don't use them alone for decisions with legal or similarly significant effects on a person. You remain responsible for contacting people lawfully (for example consent and opt-out rules for marketing email).

3. Accounts

  • You must be at least 18 and give accurate information. One person may not create several accounts to obtain additional free credits.
  • Keep your password, 2FA device and API keys secret. You are responsible for activity on your account and API keys until you revoke them.
  • Tell us promptly at support@mailquell.com if you suspect unauthorized access.

4. Credits, plans and payment

  • Each address checked uses 1 credit. Checks that fail because of an error on our side are not charged.
  • Free accounts receive 200 credits per calendar month, renewed on the 1st (UTC), plus 100 one-time welcome credits once the email address is confirmed. One free account per person.
  • Paid plans include a number of credits per day instead. Daily credits renew every day at 00:00 UTC; unused free or daily credits do not carry over.
  • Purchased credit packs and welcome credits are added to your instant balance and do not expire while your account remains open.
  • AI Lead Qualification uses separate AI credits: 1 AI credit per company website analysed (several contacts at the same company count once). Every plan includes AI credits each calendar month (renewed on the 1st, UTC, not carried over); AI credit packs do not expire while your account remains open. Websites that cannot be read and AI errors are not charged.
  • Subscriptions (monthly or yearly) renew automatically at the end of each period until cancelled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current period.
  • Prices are shown before purchase. We may change prices for future periods with at least 30 days' notice; changes never affect a period already paid for.
  • Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it processes payments, calculates and collects applicable taxes (such as VAT or sales tax), issues receipts and handles payment-related customer service and refunds. Its buyer terms apply to your purchase in addition to these Terms.
  • Refunds are described in the Refund Policy (14-day window).

5. Acceptable use

You may only use MailQuell lawfully and for list hygiene and address validation. You must comply with the anti-spam and data-protection laws that apply to you and to the people on your lists — for example CAN-SPAM (US), GDPR and ePrivacy/PECR (EU/UK), CASL (Canada) and Morocco's Law 09-08. In particular, you must not:

  • use results to send unsolicited commercial email in breach of applicable law, or to send email to people who have opted out;
  • check lists you are not legally entitled to process — including lists obtained without a lawful basis, or bought, rented or harvested lists of consumers you intend to email without their consent;
  • use the service to discover mailboxes by mass-guessing addresses at a domain ("directory harvest"), or to probe mail servers for any purpose other than validating addresses;
  • resell or give third parties access to the service or its results as a competing service without our written agreement;
  • create multiple accounts, share accounts, or otherwise circumvent credits, rate limits, or security measures;
  • use the service for phishing, fraud, harassment, malware, or to verify addresses for any illegal purpose;
  • attempt to access other users' data, test the security of the service without written permission, or disrupt it.

We monitor aggregate signals (such as unusually high invalid rates) to protect the service and our mail-server reputation. We may suspend or close accounts that breach this section; see section 12.

6. Your data

You keep all rights to the lists you upload and the results. For that data you act as the data controller and we process it only on your instructions, to provide the service. We do not sell it, share it with other customers, or use it to build our own email database. See the Privacy Policy for retention and deletion.

7. API

API use is subject to rate limits and to these Terms. Keys are tied to your account and credits. We may change or retire API versions with reasonable notice.

8. Availability and changes

We aim for high availability but the service is provided "as is" and "as available", without guarantees of uninterrupted operation. We may improve, change or discontinue features; if we discontinue the service entirely we will give at least 30 days' notice and refund prepaid, unused subscription periods.

9. Intellectual property

The software, design and content of MailQuell belong to MailQuell. These Terms give you a limited, non-exclusive, non-transferable right to use the service.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses (including lost profits, lost data, or deliverability outcomes), and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

11. Indemnity

You will compensate us for claims and costs arising from your breach of section 5 (Acceptable use) or from your use of lists you were not entitled to process.

12. Suspension and termination

You can close your account at any time from Account & Security. We may suspend or close an account that breaches these Terms, creates legal risk, or harms the service or its reputation; where reasonable we will tell you why. Unused credits are not refunded when an account is closed for breach of section 5, except where the law requires.

13. Governing law

These Terms are governed by the laws of the Kingdom of Morocco. Disputes go to the competent courts of Agadir, Morocco, without affecting any mandatory consumer protections of your country of residence.

14. Changes to these Terms

We may update these Terms. We will announce material changes by email or in the app at least 14 days before they apply. Continuing to use the service after that means you accept them.
